McLain & Merritt has one of the most comprehensive premises liability practices in the state. Howard Lessinger and the rest of the premises liability team have handled thousands of premises liability cases, ranging from the simple slip and fall to the complex product liability and premises security case. These cases have included high exposure incidents such as workplace violence, sexual assault, fatal shootings, catastrophic injury and death. McLain & Merritt has obtained as many as 56 summary judgments in premises cases in one calendar year, and has tried twelve premises liability cases to jury verdict in one calendar year. The premises liability team has over 50 published appellate opinions, many of which are often cited by the courts.

McLain & Merritt’s premises client list includes national retailers, restaurants, hospitals and shopping malls. As a member of a national retailer’s rapid response team, the firm has investigated numerous high exposure incidents in order to preserve evidence, prepare internal reports, and make remedial recommendations. The firm serves as a national coordinating counsel for a national corporation’s specialty trial group, and has conducted mock trials and focus groups in high exposure cases to develop comprehensive trial themes and defense strategies. The premises team also conducts safety seminars in an effort to reduce the number of premises incidents and claims.
